Atascadero adopts social host ordinance to curb illegal fireworks

ATASCADERO — On Dec. 9, the Atascadero City Council unanimously approved a new Fireworks Social Host Ordinance aimed at reducing illegal fireworks, enhancing public safety, and protecting neighborhoods during high-risk fire periods. The ordinance is effective immediately.
Illegal fireworks have long been a concern in Atascadero, particularly around Independence Day and New Year’s Eve, posing fire hazards, disturbing residents and animals, and straining emergency services. The new ordinance provides city officials with stronger enforcement tools to prevent such dangers.
Key Provisions:
- Social Host Liability: Property owners or hosts are strictly responsible for illegal fireworks discharged on or near their property.
- Administrative Fines: Violations may result in fines of $1,000 per incident, up to $10,000 per day.
- Criminal Penalties: Violations can be prosecuted as misdemeanors when appropriate.
- Cost Recovery: The City may recover expenses related to emergency responses, including personnel, equipment, and medical costs.
“Illegal fireworks put our entire community at risk,” said Police Chief Dan Suttles. “This ordinance gives us a more practical and enforceable way to hold people accountable and to keep our neighborhoods safe. Our goal is to prevent fires, prevent injuries, and give residents some peace during the holidays.”
What residents should know:
- All fireworks, including “Safe and Sane,” remain prohibited within city limits.
- The ordinance applies to property owners, renters, and anyone hosting gatherings.
- Hosts may be liable even if they did not personally set off fireworks.
- Taking preventative steps, such as informing guests and reporting violations, can help avoid liability.
